  • RECOMMENDATION:

    THAT the March 26, 2025 Committee of Adjustment Meeting Agenda be approved as presented.

  • RECOMMENDATION:

    THAT the minutes of the January 22, 2025 Committtee of Adjustment Meeting be adopted as presented.

  • RECOMMENDATION:

    THAT Consent Applications B-02/2025 and B-03/2025, requesting permission to sever a total of two (2) vacant residential building lots intended for development with semi-detached dwellings, be denied.

    THAT Consent Applications B-04/2025 and B-05/2025, requesting permission to sever a total of two (2) vacant residential building lots, intended for development with semi-detached dwellings leaving a retained lot intended for a single detached dwelling, be approved, subject to the following condition(s):

    1. That the Owner submit to the Municipality an electronic copy of a reference plan showing the severed lot or submit a written description which is acceptable to the County of Lambton Registrar;
    2. That any municipal taxes and local improvements including interest and penalties thereon that may be owing and payable with respect to the lands be paid to date;
    3. That the applicant pay the Municipality’s deed stamping fee for each transfer document stamped;
    4. That each of the severed lots (B04/2025 and B05/2025) have a lot frontage of at least 10 m and the retained lot be located at the north side of the lands and have a lot frontage of at least 17 m;
    5. That the drainage apportionment be divided between the resultant parcels, if applicable;
    6. That the applicant install independent connections to municipal water, storm, and sanitary sewer mains for each of the resulting lots where connections do not already exist;
    7. That the applicant pay to the Municipality a $1000 cash-in-lieu of parkland dedication for each residential lot created ($2000 in total); and
    8. That all conditions be fulfilled and the certificate of consent required by Section 53(42) of the Planning Act be obtained within two years of the notice of decision of this consent.

       

    THAT Minor Variance Applications A-02/2025 to A-05/2025, affecting lands known as 65 MacNab Street, to permit a lot frontage for the resulting lots of 9.2 m for Lots 1, 2 and 3 and 9.3 m for Lot 4, be denied.

  • RECOMMENDATION:

    THAT Minor Variance Application A-06/2025, affecting lands known as 8434 Defore Drive, Lambton Shores, which would permit a 2 m solid type construction fence in a front yard, be approved, subject to the following condition(s):

    1. That the applicant pay any outstanding fees and obtain any permits required by the Ausable Bayfield Conservation Authority (ABCA); and
    2. That the variance only apply to permit construction as shown in the applicant’s sketch.
  • RECOMMENDATION:

    THAT Minor Variance Application A-07/2025, affecting lands known as 76 Union Street, Forest, which would permit a fourplex divided vertically into four units and locate a driveway and parking area along an interior side lot line with a 0 m landscape strip, be approved, subject to the following condition(s):

    1. That a 3 m planting strip consisting of a cedar hedge or a fence and row of trees be established on the western and northern property lines of subject lands where for the portions abutting the parking area; and
    2. That the variance only apply to permit construction as proposed in the applicant’s sketch.
  • RECOMMENDATION:

    THAT Minor Variance Application A-08/2025, affecting lands known as 7571 Cornell Trail, Port Franks, which would permit an accessory structure in a front yard, be approved, subject to the following condition(s):

    1. That the applicant pay any outstanding fees and obtain any permits required by the Ausable Bayfield Conservation Authority; and
    2. That the variance only apply to permit construction as proposed in the applicant’s sketch.
  • RECOMMENDATION:

    THAT Consent Application B-06/2024, requesting permission to sever a lot from the lands known as 34 Alberta Street, Grand Bend, having approximately 10.185 m (33.41 ft) frontage and 629.05 m2 (6,771.04 ft2) lot area containing a partially constructed semi-detached dwelling, leaving a retained parcel with approximately 10.211 m (33.5 ft) frontage and 639.25 m2 (6,880.82 ft2) lot area, containing a partially constructed semi-detached dwelling, be approved, subject to the following condition(s):

    1. That the Owner submit to the Municipality an electronic copy of a reference plan showing the severed lot or submit a written description which is acceptable to the County of Lambton Registrar;
    2. That any municipal taxes and local improvements including interest and penalties thereon that may be owing and payable with respect to the lands be paid to date;
    3. That the applicant pay the Municipality’s fee to stamp the deed;
    4. That the applicant install an independent connection to municipal water, storm, and sanitary sewer mains for the severed lot;
    5. That the applicable road authority be satisfied that the resultant parcel has suitable, independent road access, or the applicant install or upgrade entrances as required by the road authority;
    6. That the applicant pay to the Municipality a $1000 cash-in-lieu of parkland dedication on the severed lot;
    7. That all conditions be fulfilled and the certificate of consent required by Section 53(42) of the Planning Act be obtained within two years of the notice of decision of this consent.
  • RECOMMENDATION:

    That the meeting adjourns at     p.m.
