    THAT the Council Meeting adjourns at 7:08 p.m. for Public Meetings held under the Planning Act to hear applications for Zoning By-Law Amendments:

    ZO-14/2021 - Velma MacLachlan - 8375 and 8381 Defore Drive;

    ZO-16/2021 - MFL Properties Ltd. - 17 Pine St., Grand Bend;

    ZO-17/2021 - Lambton Kent District School Board - Beechwood Ave. and Townsend Line; and

    ZO-18/2021 - Doug Pedlar - 9782 Northville Crescent.

Planner Will Nywening introduced the application and summarized the purpose of the zoning by-law amendment.  He stated that the applicant is requesting the rezoning as a condition of consent.  He stated that the amendment will rezone 8375 Defore Drive to a residential zone, portions of 8381 Defore Drive to a residential zone allowing an oversized accessory building, and the agricultural portions of 8381 Defore Drive to prohibit a dwelling.  He stated that staff is in support of the application.

Kim MacLachlan, applicant, was present for the meeting.  She stated that they do not agree with the recommendation to move the cul de sac and do not believe it is necessary for their development.

The Clerk noted that there was no correspondence received for this application.  There were no members of the public present at the meeting wishing to speak to this application.

Will Nywening, Planner, stated the purpose and effect of the application noting that the applicant proposes to construct a 3-storey, triplex dwelling with special provisions.  He summarized the staff report which is not supportive of the application.

Jay McGuffin and Hannah Surgenor, Monteith Brown Planning Consultants representing the applicant were present for the meeting.  The applicant was also in attendance.  Mr. McGuffin made a presentation on behalf of his client stating that they do not agree with the staff report prepared by Mr. Nywening. He noted that they intend on withdrawing the request for the rooftop patio amenity and are requesting that a decision be deferred in order to allow the applicant to address some of the concerns brought forward.

The following individuals spoke at the public meeting:

Dan Doroshenko of 53 Huron Street expressed concern with the development noting issues with both transition and mass of the development as well as the R4/R3 zoning in Plan 24.

Mike Allison of 49 Gill Road stated that he is in support of the development.  He indicated that the development is no taller or wider than any building in the area.

Gerry Roeder of Lambton Shores Community Association stated that this rezoning does not respect or protect the beach.  The association supports the planner's report.

Chelsea Middleton of 16 and 18 Pine Street stated that her properties are most impacted by the development and she is in full support of the application.  She stated that the building will help with blowing sand on the public walkway.

Kevin Coonan of 55 Lake Road is in support of the application. He stated that there is no impact of views from Main Street, tri plex and duplex are good things, less carbon footprint and provides more housing. 

Will Nywening, Planner, stated the purpose and effect of the application noting that the rezoning will allow for the development of a school on the site and is a condition of consent granted by the Committee of Adjustment.  He summarized the staff report noting that staff is supportive of the application.

Brian McKay and Joseph Ouilette representing the school board were present for the meeting and supportive of the staff report.

There were no members of the public present wishing to speak to the application.

The Clerk stated that no correspondence had been received for this application.

Planner Will Nywening summarized the report in support of the application.  He stated the purpose and effect of the application was to permit a single detached dwelling on the proposed new lot.

Garrett Pedlar, agent for the applicant, was present for the meeting and in support of the planning report and recommendation.
